The Registrar will permit an electric motor driven cycle to be registered if it meets Canada Motor Vehicle Safety Standards (CMVSS) as a Limited Speed Motorcycle, or Scooter as is done with gas powered motor driven cycles. If the vehicle was manufactured after 1988 it will bear a compliance label stating that it meets these standards. The operator will be subject to all the requirements placed on operators of motor driven cycles.
This article did a good job of trying to justify the assist speed limits but fell short of detailing how that can ever be effectively enforced. In reality the only enforcement that is going to work is applied speed limits to use of bikes and ebikes. For example, it makes sense that a bike lane on a street that the speed limit of vehicles is the speed limit of the bikes/ebikes. On sidewalks and shared pedestrian paths the speed limit probably does need to be in the 15-20mph range to match traditional bikes speeds on those paths.
Some US companies, notably in the tech sector, are developing both innovative cycle designs and cycle-friendliness in the workplace. Foursquare, whose CEO Dennis Crowley "pedaled to pitch meetings ... [when he] was raising money from venture capitalists" on a two-wheeler, chose a new location for its New York headquarters "based on where biking would be easy". Parking in the office was also integral to HQ planning. Mitchell Moss, who runs the Rudin Center for Transportation Policy & Management at New York University, said in 2012: "Biking has become the mode of choice for the educated high tech worker".
The 1968 Vienna Convention on Road Traffic of the United Nations considers a bicycle to be a vehicle, and a person controlling a bicycle (whether actually riding or not) is considered an operator. The traffic codes of many countries reflect these definitions and demand that a bicycle satisfy certain legal requirements before it can be used on public roads. In many jurisdictions, it is an offense to use a bicycle that is not in a roadworthy condition.
At just 36V and 5.2 Ah, the battery is not designed for long distance travel. GOTRAX claims the Shift S1 has a range of up to 15 miles (25 km), though that’s only with a lower pedal assist level. If you’re going full throttle, 10 miles (15 km) is a better estimate. But with a battery this small, you could easily charge it at your desk or in the corner of the classroom – lengthening your effective range.

Operators are subject to driving rules and equipment requirements (if applicable) when operated on the public streets or highways (which includes the main traveled portion of the road, shoulder and sidewalk). This means that an operator could be cited for speeding, failure to signal, unsafe change of course, driving on the sidewalk, DWI (this would apply to anywhere in the state and not just the streets/highways), and all other driving rules contained within state law that would apply. They may also not ride more than two abreast and may not impede the normal and reasonable movement of traffic. On a laned roadway, they must operate within a single lane.
Awesome little machine. My wife loves it. She gets so many people asking her where she got it and that they want one too. I have an 6 speed/ electric bike but she is not comfortable riding it or any bike for that matter but she’s totally comfortable and confident when she rides the swag. Great product. No person may drive either a two-wheeled or a three-wheeled motorcycle, or a motor-driven cycle unless such person has a valid driver's license specially endorsed by the director to enable the holder to drive such vehicles. No driver's license is required for operation of an electric-assisted bicycle if the operator is at least sixteen years of age. Persons under sixteen years of age may not operate an electric-assisted bicycle. Persons operating electric-assisted bicycles shall comply with all laws and regulations related to the use of bicycle helmets. Electric-assisted bicycles and motorized foot scooters may have access to highways of the state to the same extent as bicycles. Electric-assisted bicycles and motorized foot scooters may be operated on a multipurpose trail or bicycle lane, but local jurisdictions may restrict or otherwise limit the access of electric-assisted bicycles and motorized foot scooters, and state agencies may regulate the use of motorized foot scooters on facilities and properties under their jurisdiction and control.
But the good times of the stealthy ebike existence will not endure forever. The ebike market is growing steadily and more so, technology is driving performance up and costs down. The market for a green, lifestyle friendly, transportation technology, with GPS, theft ID, cell service and probably skim lattes is alive and driving an emerging market. It is a matter of time before we all must face and respond to the legal demands of the state and local laws. Not to be over obligatory about being legal and duty oriented, but I do call on my fellow ebikers to ride legal, whether ebike, moped or other. Go ahead and build the 1200W ebike of your dreams, but get it insured and licensed if you must. Such compliance will set the precedence for public acceptance of ebikes in general, and build a track record for expansion and mainstreaming of moped-speed ebikes for commuter value driven needs of the future.
