The pedals on a motorised bicycle must be the primary source of power for the vehicle. If the motor is the primary source of power then the device cannot be classed as a motorised bicycle. For example, a device where the rider can twist a throttle and complete a journey using motor power only without using the pedals, would not be classed as a motorised bicycle.

Maybe the most confusing legal issue facing e-bike riders today is the difference between a bike lane and bike path. A bike lane is a marked section of roadway shared with motor vehicles. I had gotten this to build an electric bike but I have never worked with wires before so I didn't realize that we needed to attach our own connectors to the wires. The person who I talked to at Joyisi was super nice and explained that to me and even offered to send me connectors for free. I had already ended up getting a different bike altogether though and so I just wanted to return the battery. But because I am returning it for my own reasons (as opposed to the battery being faulty), they would normally have me pay for return shipping and deduct the cost of shipping to me (which is a lot, because they are international) and the inspection fee from my refund, but they were super nice and offered to take on most of the costs and I would only have to pay for the return
State laws tend to intermix the source of power as either gasoline ICE or electric drive. This is unfortunate because that neutralizes the environmental advantage of an ebike over an ICE moped. It also misrepresents the contrast in power output levels between an ICE and electric motor system. 50cc gas mopeds/scooters have a 2.5-4 HP rating, while the 20+ mph electric bikes will be 1-2hp, and ride much closer to a normal bicycle compared to a gas powered, 2.5hp moped. E-mopeds will weigh 55-70lbs. Gas mopeds and scooters are typically over 120lbs. E-mopeds are still electric bikes that get valuable power assist from human pedal effort and are usually much quieter.
But electric bicycles—e-bikes—are new territory for me. Broadly speaking, there are two basic options in e-bike land: power-on-demand and pedal-assist. With the former, the rider can control the speed with a throttle instead of just pedaling. Think moped but with an electric motor instead of internal combustion. Pedal-assist, by contrast, requires the rider to do some of the work. The electric motor won't engage unless the rider is pedaling.
